A House Smaller Than Four by Four Amos

בית שאין בו ארבע אמות
Sukkah 3b · Thursday, April 23, 2026

The sugya

The Gemara lists halachos that do not apply to a house smaller than 4x4 amos. It asks whether this list follows only Rebbi, who requires a sukkah of 4x4, and answers that even the Rabbanan agree: a sukkah is a diras arai, but a house is a diras keva and is only livable at 4x4. The Gemara then goes back through the list ('Amar Mar'), giving the source for the five d'oraisa items (the word bayis) and the reason for the eruv items (lo chazi l'dirah). It then distinguishes eruvei chatzeiros, which cannot be placed in such a house, from shitufei mevo'os, which can.

Step by step (shakla v’tarya)

  1. ChazarahFinishing yesterday's list of ways a bayis smaller than 4x4 amos is different.
  2. GemaraEin osin oso ibbur bein shtei ayaros: a small house under 4x4 on the line between two cities cannot join them into one city for Shabbos. The two cities cannot be more than 140 amos apart (70 and 70).
  3. GemaraBrothers who inherit it, or partners, cannot force a split; it is not a divisible entity.
  4. Discussion of what happens practically, perhaps a buyout or selling it. The Rebbi left this open: 'we'll see', since it is discussed lower on the amud.
  5. KashaLeima Rebbi hi v'lo Rabbanan: this whole 4x4 restriction seems to come from Sukkah, where Rebbi requires a minimum of 4x4. So perhaps the entire list (mezuzah, maakeh, army, etc.) follows only Rebbi.
  6. TeirutzEven the Rabbanan agree. They only allowed less than 4x4 by sukkah, which is inherently a diras arai. A house is a diras keva, and even the Rabbanan modu: at 4x4 people live in it, and less than that they do not.
  7. MaskanaThe list is universal and no one disputes it. Rebbi's reason by sukkah will be seen later, on daf zayin.
  8. GemaraAmar Mar: the Gemara goes back to examine each item more closely, splitting the list into subcategories.
  9. GemaraFirst group of five: patur from mezuzah and maakeh; not tamei with nega'im; not nechlat in batei arei choma; one does not return from the army for it. Ma'taima? Because bayis is written in all of them.
  10. The RebbiThese are five different pesukim. The Torah could have used other words (family, dirah, going home), yet it consistently uses bayis. A bayis is a universal shiur of 4x4, which the Rabbanan never disputed.
  11. The RebbiThe Gemara did not start with this halacha because it came to it from Sukkah, bringing it only as a kasha on whether the shiur is Rebbi's alone.
  12. GemaraSecond group, the eruv items. Ein me'arvin bo: it need not participate in eruv chatzeiros. Ein mishtatfin bo: it need not participate in the alleyway shituf. Ein manichin bo eruv: the eruv cannot be placed in it.
  13. GemaraMa'taima? Because lo chazi l'dirah, it is not fit for dwelling. This is a practical reason; there is no pasuk here.
  14. The RebbiThe point of an eruv is to treat all the residents as living in one shared dirah. This person is not really living there; he is like someone camped in the hallway.
  15. GemaraEruvei chatzeiros ein manichin bo, aval shituf manichin bo: the chatzer bread cannot be hosted in this 'broom closet', but the bread shared by the developments off one alleyway can be.
  16. GemaraMa'taima? Lo garu mechatzer shebamavoi: it is no worse than a courtyard off the alleyway. The alleyway shituf may be placed even in an open courtyard; it need not be in a house at all, since it joins chatzeiros, not houses.
  17. The Rebbi noted that this is a confusing point, and the Gemara's next question will press on it.
  18. ChazarahRecap of the three eruv cases. A resident of a tiny house need not join the eruv chatzeiros. A development with only a tiny house need not join the alleyway shituf. Ein manichin bo refers only to the chatzer eruv, since the alleyway one can go anywhere.

Kashas

  • Leima Rebbi hi v'lo Rabbanan: is the 4x4 requirement for a house only according to Rebbi, who requires 4x4 for sukkah?
  • The Gemara's upcoming question on 'lo garu mechatzer shebamavoi' (to be learned next).

Teirutzim

  • Even the Rabbanan agree. Sukkah is diras arai, while a house is diras keva and is only lived in if it is 4x4.
  • The five d'oraisa items depend on 4x4 because the word bayis is written in all of them.
  • The eruv items depend on 4x4 because such a house is lo chazi l'dirah.
  • Shituf may be placed in it because it is no worse than a chatzer shebamavoi.

Mareh mekomos

  • Rebbi's shita in Sukkah that a sukkah must be at least 4x4 amos: the basis of the kasha.
  • Daf zayin: where the reason for Rebbi's shiur by sukkah will be seen.
  • The pasuk of batei arei choma uses 'beis moshav': an example of the word bayis in these pesukim.

The Rebbi’s chiddushim

  • 'Amar Mar' is the Gemara's way of slowing down to examine something it passed by.
  • The Torah's consistent use of bayis across five unrelated pesukim shows a universal shiur of a house, accepted even by the Rabbanan.
  • An eruv makes everyone one shared dwelling. Someone in a space under 4x4 is not really dwelling there, so he is not part of it.
  • The alleyway shituf joins chatzeiros, not houses, so it can be placed anywhere, even in an open courtyard.
  • An amah is about two feet, so 4x4 amos is roughly 8x8 feet, like today's tiny houses.

Unclear in recording

  • The daf/amud stated at the opening.
  • The practical halacha for brothers/partners with such a house (buyout, sale, renting); left open for later.
  • A remark about applying the lo chazi l'dirah reason to the first group, and whether a storage room needs a mezuzah.
  • A short garbled passage before the eruvei chatzeiros line.
  • Instructions about marking the text ('give him a mouth').

Drafted from the recording of the shiur, for chazarah. Torah terms follow the Rebbi’s own words; anything that could not be made out is marked “unclear in recording”. Tap a time to hear that point. Corrections welcome.
